Co-sponsor House Joint Resolution 127, the Parental Rights Amendment, now. Government agencies like DCYF are increasingly substituting their own judgment for parents' decisions, and families in my community are paying the price. This amendment would enshrine in the Constitution what the Supreme Court recognized in Wisconsin v. Yoder — that parental rights are "an enduring American tradition" — and require government to meet the highest legal standard before overriding a parent's decisions about their child's upbringing, education, and care.
Right now, there is no explicit constitutional protection stopping a caseworker or school official from overriding a parent's choices with little accountability. HJRes. 127 closes that gap. It protects the right to direct education, including the choice of private, religious, or home schooling, and ensures these rights cannot be stripped away based on disability. The 1925 Supreme Court made clear that "the child is not the mere creature of the State." It's past time Congress made that permanent. Contact Worth Loving in Rep.
