The Protection of Lawful Commerce in Arms Act (PLCAA) serves an important purpose in preventing frivolous lawsuits that could bankrupt law-abiding gun manufacturers and dealers for crimes they did not commit. While concerns about gun violence are understandable, holding companies financially liable for the criminal misuse of legal products by others sets a dangerous precedent that could extend far beyond the firearms industry. The PLCAA still allows lawsuits for defective products, breach of contract, criminal misconduct, and negligent entrustment when there are legitimate grounds. However, it provides reasonable protections to prevent the destruction of a lawful industry via never-ending lawsuits over acts they did not commit or facilitate. Maintaining this measured law upholds the letter and intent of the Constitution while allowing recourse through proper legal channels. Repealing or undermining the PLCAA would open the floodgates to unwarranted litigation that could cripple a lawful industry and the legal rights it represents.
