The Trump administration's proposal to suspend habeas corpus and deprive migrants of due process under the law is a grave threat to constitutional rights and democratic principles. Habeas corpus is a bedrock legal protection that prevents unlawful detention by allowing individuals to challenge their imprisonment before a neutral judge. Suspending it would strip away this fundamental safeguard and enable indefinite detention without any judicial oversight or accountability. The claim that an "invasion" of migrants justifies such an extreme measure is alarmist rhetoric that fails to meet the high legal bar of suspension being permitted only in cases of actual rebellion or invasion threatening public safety. Immigration, no matter the numbers, does not constitute an invasion in the constitutional sense. Migrants are human beings seeking a better life, not enemy combatants.
