I am writing as your constituent to express my strong opposition to House Bill 512, titled "Judicial Retention Changes." Concerns Regarding H.B. 512: Unnecessary Oversight: The bill proposes the creation of a Joint Legislative Committee on Judicial Performance, which would duplicate the efforts of the existing Judicial Performance Evaluation Commission (JPEC). JPEC, established by the Legislature, already includes members appointed by legislative leadership, the Governor, and the Chief Justice, ensuring a balanced and comprehensive evaluation process. Threat to Judicial Independence: Granting the Legislature increased influence over judicial evaluations could compromise the separation of powers, potentially undermining the judiciary's ability to function impartially and independently. Lack of Justification: There is no clear evidence suggesting that the current judicial evaluation system is flawed or in need of additional legislative oversight. Implementing such changes without demonstrated necessity could lead to inefficiencies and politicization of the judiciary. As your constituent, I urge you to oppose H.B. 512 to preserve the integrity and independence of Utah's judicial system. Thank you for considering my perspective on this critical issue.
