Protect Transgender Rights: Oppose Passport Gender Marker Restrictions
To: Justices Court
From: A constituent in Stevensville, MI
September 19
I am deeply concerned about the Trump administration's recent request to the Supreme Court to limit passport sex markers for transgender and nonbinary individuals. This action, following the January executive order recognizing only two unchangeable sexes, is a direct threat to the safety and rights of transgender Americans.
The State Department's suspension of processing passport applications with the 'X' gender marker is a significant step backward. This reversal of the Biden administration's inclusive policy, which allowed Americans to select 'X' as their gender marker starting in April 2022, puts transgender individuals at unnecessary risk.
A federal judge in Massachusetts has already blocked the enforcement of this discriminatory policy nationwide through a class-action lawsuit. The judge rightly noted that affected individuals would face "irreparable harm" and increased risks of discrimination and violence when using their passports. This ruling underscores the real-world consequences of forcing transgender people to use identification documents that do not match their gender identity.
The administration's argument that private citizens cannot force the government to use "inaccurate sex designations" on identification documents is fundamentally flawed. It fails to recognize the lived experiences of transgender individuals and the importance of affirming their identities. Moreover, it contradicts established medical and psychological understanding of gender identity.
I urge you to oppose any attempts to restrict gender markers on passports. Forcing transgender individuals to use passports that do not reflect their true gender identity puts them at risk of discrimination, harassment, and violence. It does nothing to enhance public safety and instead creates unnecessary barriers for a vulnerable population.
Please take a stand for the rights and safety of transgender Americans. Support policies that allow individuals to have identification documents that accurately reflect their gender identity. This is not just a matter of personal freedom; it's a crucial step in ensuring the safety and dignity of all citizens.
