While the country is focused on the nomination of Brett Kavanaugh to the Supreme Court, Republicans are trying to end the Affordable Care Act’s ban on pre-existing conditions. If they win, health insurance companies would once again be able to deny Americans insurance or charge usuriously high rates to the sick and infirm.

The challenge takes the form of a lawsuit filed in Texas. Twenty states* filed argue that the remaining portions of Obamacare not repealed by Congress in the 2017 Billionaire’s Tax Cut are now unconstitutional because Congress ended the insurance mandate.

Now, by nearly every sane and reasonable assessment this is an objectively bad argument; but that doesn’t matter. Congress lacked the political will to eliminate the popular parts of the Affordable Care Act and now Republicans are trying to use the Court to do that dirty work for them. If they succeed, the case will be appealed and it’s highly likely that it will be appealed all the way to the Supreme Court, where Mr. Kavanaugh may be called upon to decide it.

But ponder, for a moment, exactly what the Republican leadership of these twenty states are trying to accomplish. They’re fighting, in the most literal sense, to let people die so that health insurance companies can pad their bottom line.

Kavanaugh’s confirmation isn’t a sure thing. He’s the most unpopular Supreme Court nominee in a generation and Republicans are going to have to work hard to hold their Senate delegation together to ram him down America’s throat. Register to Vote
