Oppose PERA and PREVAIL Acts, curb patent abuse
To: Sen. Wyden, Sen. Merkley
From: A constituent in Clackamas, OR
November 14
I urge you to stand against the Patent Eligibility Restoration Act (PERA) and the PREVAIL Act. These bills would undo critical reforms that have helped curb abusive patent litigation by patent trolls. PERA would once again allow patents on abstract ideas like basic software functions and even human genes. This would open the floodgates for vague, overly broad patents that patent trolls frequently wield against small businesses and innovators through costly litigation. The PREVAIL Act aims to limit the ability to challenge low-quality patents through inter partes review (IPR) proceedings at the Patent Office. The IPR process has been crucial for weeding out thousands of dubious patents that never should have been issued. Restricting this review process benefits no one except those looking to monetize bad patents. At a time when we should be promoting American innovation, these bills take us in the wrong direction by empowering patent trolls and hampering legitimate businesses. I urge you to publicly oppose PERA and PREVAIL to protect against abusive patent practices that stifle competition and economic growth. We cannot afford more bad patents.
