As attacks on the rights of women, girls, and LGBTQ+ individuals surge nationwide, the Equal Rights Amendment is essential for protecting against a dangerous, regressive agenda. With the impending threat of the next Trump administration and their Project 2025 agenda, which seeks to strip away hard-won civil rights, we cannot afford further delay. Your administration's commitment to equality has been clear, but now we need action to protect the most vulnerable among us. Publishing the ERA is a critical line of defense against this encroaching threat against the rights and safety of millions of Americans. The ERA has already satisfied all constitutional requirements, achieving full ratification in 2020 with Virginia's support as the 38th state. However, the former Trump administration's interference blocked publication, even as respected constitutional scholars confirm the ERA has been ratified and should be published in the U.S. Constitution. Until it is published, it remains in a dangerous legal limbo, leaving critical protections for reproductive and LGBTQ+ rights vulnerable. President Biden, this moment demands bold action. We call on you to safeguard our democracy by directing the Archivist to publish the ERA immediately, establishing it as a necessary shield against an impending assault on equality, justice, and the rights of all Americans.
