I write to you today with outrage and alarm. Your recent passage of “the Big Beautiful Bill” (H.R. 1 / P.L. 119-21) contains a profoundly dangerous, hidden provision: Section 70302. This is no harmless technical fix—it’s an assault on the foundations of our constitutional order. It must be repealed immediately.
Section 70302 effectively strips federal courts of their power to enforce contempt orders against officials who defy injunctions or restraining orders when “no security was given” under Rule 65(c). In plain English, it lets officials ignore judicial rulings and hide behind procedural “technicalities” to escape punishment. That’s not reform—it’s sabotage.
By passing this clause, the GOP has created a shield for lawbreakers in power. Courts can no longer punish those who defy judges unless a bond is posted first—a ludicrous barrier that protects the powerful and punishes the public. This is how democracies erode: quietly, under the cover of complexity, while those responsible insist it’s just “a detail.”
Don’t let corrupt politicians hide behind that excuse. Section 70302 guts judicial authority, dismantles separation of powers, and invites lawlessness. It was slipped into the bill with intent—to weaken accountability and place certain people above the law.
If anyone tells you repeal must “wait” or is “too complicated,” understand this: delay is betrayal. Every day this clause remains law is a day the rule of law grows weaker.
You swore an oath to defend the Constitution, not to help dismantle it. If you believe in justice, integrity, and the survival of our democratic system, then you must act now:
1. Draft and introduce a repeal of Section 70302 immediately.
2. Commit to voting for repeal—even if it means crossing party lines.
3. Publicly oppose any defense of this provision within your party.
I’m asking you directly, as my representative, to take a clear stand. Use your voice, your vote, and your platform to repeal Section 70302 before it inflicts irreversible harm. The people you serve deserve leaders who defend the rule of law—not those who look away while it’s dismantled.
