Rebuilt Letter Why Is USPS Defying a Federal Court to Decide Who Gets to Vote by Mail? I am asking you to stop the U.S. Postal Service from rewriting how millions of Americans cast their ballots, and to hold the agency accountable for defying a federal court order in the process. On March 31, 2026, President Trump signed an executive order directing USPS to build a new “Federal Ballot Mail Portal” that would let the agency refuse to deliver mail-in ballots to voters who aren’t on a state-submitted list. A coalition of 23 states and Washington, D.C. sued to block it, and on August 11, U.S. District Judge Indira Talwani issued a nationwide injunction barring USPS from carrying out that provision before the midterms. No ballot has been refused yet — the rule is still enjoined — but on August 22, just days after that injunction, USPS published a 95-page final version anyway, stating it will implement the requirements “immediately” the moment a court lets it, and that it will withhold delivery from any state that hasn’t complied. Twelve Republican-led states have now appealed the injunction, and with the case positioned for possible Supreme Court review, that green light could come with little warning before ballots go out this fall. This isn’t a partisan fringe concern. USPS is an independent agency Congress built specifically to be insulated from this kind of political interference, and the rule threatens military families, seniors, and voters with disabilities who depend on mail voting most. Election Day falls on a workday, and not everyone can take time off to stand in line. I’ve relied on mail voting for exactly that reason, and I don’t think a federal agency should get to decide, days before an election, that my state moved too slowly on a paperwork requirement it invented. I am asking you to: • Cosponsor and push for a floor vote on the Vote by Mail Protection Act (H.R. 8666), which would invalidate this executive order and bar federal funds from implementing it • Demand USPS leadership testify before Congress on why it finalized this rule days after being enjoined • Oppose any appropriations that fund the Federal Ballot Mail Portal or related ballot-screening infrastructure There’s no legitimate answer to why an agency would finalize a rule a federal judge just blocked — and until Congress makes USPS answer for it, nothing stops the agency from doing it again the next time it doesn’t like a ruling.
