An Open Letter

To: Sen. Schmitt, Rep. Graves, Sen. Hawley

From: A constituent in Plattsburg, MO

March 17

You ignored my email from February 2026 after the SCOTUS decision. I find it rich that the Supreme Court had to tell you what your job is – I’m annoyed YOU don’t know. The International Emergency Economic Power Act (IEEPA) does not authorize the president to impose tariffs and SCOTUS has made clear that tariffs are the job of CONGRESS. Chief Justice Roberts wrote, “The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises.” The Framers did not vest any part of the taxing power in the Executive Branch. I asked numerous times WHY you did not assert the power of YOUR office and control tariff policy. In fact, many Republicans know this, per Sen. Rand Paul, "The Supreme Court makes plain what should have been obvious: The power to impose tariffs is very clearly a branch of the power to tax." Last week Judge Richard Eaton, U.S. Court of International Trade, directed that all tariff payments be refunded WITH INTEREST. What a mess you have created by being a doormat for the president in his illegal actions. I can only imagine the pain this has caused Americans and the government money wasted in the court defending these cases we all knew the government would lose! I’d like a reply and your comment on this situation – or are you too cowardly to comment now that you have been counseled on your job duties and smacked around by the courts?
