I am writing to demand immediate congressional oversight of Treasury General License 135, which authorizes Russian diesel imports through April 7, 2027, bypassing statutory sanctions and threatening U.S. security.
Issued October 9 after executive talks with Moscow, General License 135 drew immediate condemnation from twelve bipartisan senators calling it "a gift to our adversary and a betrayal of our Allies." Republican Senator Thom Tillis stated the President "may be breaking the law." In 2022, Congress banned Russian energy imports (P.L. 117-109) unless the President submits a 45-day certification to Congress confirming an accepted withdrawal from Ukraine. Administrative licenses cannot dismantle federal statutes without a vote.
The national security risks are undeniable:
- Civilian Casualties in Ukraine. Russia continues bombing Ukrainian cities; an October 10 strike on a Zaporizhzhia apartment killed 23 people, including four children. President Zelensky warned this sanctions relief only encourages further aggression.
- Funding Iranian Drones & Missiles. C4ADS records confirm Russia paid Iran $104 million in gold for Shahed attack drones. The U.S. confirmed Iran transferred over 350 Fath-360 ballistic missiles to Russia, and reports show Russia is now reciprocating with advanced missile technology to Tehran.
- Bypassing the Graham Act. The Graham Sanctioning Russia and Iran Act (passed 86–11 in the Senate) mandates new energy sanctions by October 18 unless a formal written waiver is delivered to Congress.
While dollars are fungible, licensing Russian energy revenues directly subsidizes an axis arming adversaries against U.S. forces.
Congress must assert its Article I constitutional authority.
I urge you to:
1. Demand a written response by October 21 on whether the administration submitted the mandatory 45-day report under P.L. 117-109 and transmitted GL 135 under CAATSA §216.
2. Require the President to enforce Graham Act measures by October 18 or publish the required national-interest waiver.
3. Cosponsor and pass the NOPE Act (S. 4421 / H.R. 9552), led by Senators Gallego and Grassley, requiring a 30-day congressional review before any Russian energy license takes effect.
4. Bar federal funds in upcoming appropriations from being used to implement General License 135, and demand a recorded vote.
Congress banned Russian energy by law. Executive agencies must not nullify that embargo.
