I am writing to express my strong opposition to TN SB0672, which seeks to increase the penalty for obstruction of a highway, street, sidewalk, railway, or other public passageway from a Class A misdemeanor to a Class E felony, with an even steeper penalty of a Class D felony for intentional obstruction of a roadway.
This bill directly infringes on the constitutional right to peacefully assemble, as protected under the First Amendment of the U.S. Constitution. Peaceful protest has long been a fundamental pillar of democracy, allowing citizens to voice their concerns and advocate for change. By imposing felony charges for such actions, this bill not only discourages lawful demonstrations but also sets a dangerous precedent for criminalizing free speech and civic engagement.
Additionally, elevating obstruction-related offenses to felony status is a disproportionate response to the alleged crime. Felony convictions carry severe, life-altering consequences, including loss of voting rights, employment barriers, and long-term social stigma. Penalizing individuals with such harsh measures—especially when their intent is to express political or social grievances—fails to align with principles of justice and fairness.
While I recognize the need to maintain public order and ensure safety, there are already existing laws that address obstruction without resorting to excessive criminalization. Instead of suppressing voices through punitive measures, I urge you to consider alternative approaches that balance public safety with the preservation of civil liberties.
