I write to you with alarm: Donald Trump has authorized what appears to be military deployment in Chicago under the guise of law enforcement or “cartel attacks,” a move that flagrantly violates well-established statutes and constitutional limits.
Under the Posse Comitatus Act (18 U.S.C. § 1385), federal military forces are barred from executing domestic law enforcement functions unless explicitly authorized by Constitution or Congress. Trump’s use of federal troops in a city — particularly without state consent or invocation of constitutional exceptions — runs directly counter to this prohibition.
The only lawful exception is through the Insurrection Act (10 U.S.C. §§ 251–253), which allows domestic military use in the case of insurrections, rebellion, or when civil authorities are unable or unwilling to enforce law. To my knowledge, no formal invocation of the Insurrection Act has been made — and no situation justifying it has been established.
Congress must act immediately:
1. Hold hearings to demand legal justification for this deployment.
2. Pass legislation or resolutions condemning the violation of Posse Comitatus.
3. Initiate impeachment or other oversight measures to rein in this abuse of executive power.
Allowing this to stand will shatter the boundary between military and civilian spheres that is fundamental to democracy
