Opposition to the SAVE Act (S. 128) – Protecting the Freedom to Vote

To: Sen. Banks, Sen. Young

From: A constituent in Elkhart, IN

February 1

I am writing as your constituent to express my strong opposition to the Safeguard American Voter Eligibility (SAVE) Act. While I support the goal of ensuring only eligible citizens vote, this legislation addresses a problem that is already prohibited by federal law and vanishingly rare in practice. Instead, the bill creates significant new barriers that would disenfranchise millions of eligible American citizens. I urge you to oppose this bill for the following reasons: Disenfranchisement of Eligible Citizens: Research from the Brennan Center for Justice shows that 21.3 million Americans (nearly 1 in 10 voting-age citizens) lack easy access to proof-of-citizenship documents like a birth certificate or passport. Harm to Specific Populations: The requirement to provide documentation in person would disproportionately impact married women whose names do not match their birth certificates (affecting as many as 69 million women), rural voters who must travel long distances to election offices, and seniors or students who may not have current passports. Elimination of Efficient Registration: The bill would effectively end online, mail-in, and automatic voter registration, forcing all voters to register in person with physical documents. Burden on Election Officials: It places an unfunded mandate on state and local officials and threatens them with criminal penalties for administrative errors, potentially worsening the current shortage of election workers. Risk of Erroneous Purges: The bill mandates voter roll purges using notoriously inaccurate databases. Past attempts at such purges, such as in Texas and Alabama, have wrongly flagged thousands of legitimate U.S. citizens. Congress should focus on protecting and expanding the right to vote, not passing unnecessary hurdles that silence everyday Americans. I urge you to vote NO on the SAVE Act.
