The Supreme Court has expanded their use of the Shadow Docket dramatically beyond just accepting cases with immediate life and death consequences, like death penalty appeals, to now deciding an unprecedented number of executive actions that would result in a usual and customary delay as they work their way through the courts.
This is an abuse of what was supposed to be an Emergency Docket for political purposes.
Congress serves as a check on both other branches, through rule making and through budget allocation. Use your levers of power to ensure that SCOTUS cannot continue to issue decisions that have lasting consequences without providing their detailed legal reasoning for lower courts, affected parties, and the American public. Tie their compliance to their budget allocation, as court officers and attorneys around the country are so familiar with. No legal mind in the nation expects to decide matters of legal consequence based on vibe.
Return accountability to the Supreme Court.
