Today I take pen in hand to write and urge you to support Senator Ruben Gallego's One Fair Price Act, which would prohibit companies from using artificial intelligence and personal data to charge different customers different prices for the same product at the same time. This creepy and disturbing practice, known as surveillance pricing, allows corporations to compile Americans' personal information including location data and device type to determine each customer's maximum willingness to pay. A Federal Trade Commission study in January revealed that retailers frequently use this personal information to set tailored prices, essentially exploiting consumers by identifying their financial pain points. Unfortunately, the FTC canceled this investigation under the Trump administration, and this makes congressional action even more critical. Surveillance pricing is fueling our affordability crisis and making the economy feel rigged against ordinary Americans. When companies can charge me one price while charging my neighbor a different price for an identical product based on data they've collected about us, it erodes consumer solidarity and threatens our financial independence. This isn't fair market competition. It's predatory pricing that extracts maximum profit from each individual consumer. The One Fair Price Act would ban this discriminatory practice while protecting legitimate discounts and ensuring predictable pricing. This legislation builds on Senator Gallego's broader consumer protection work, including his efforts to investigate Delta's AI pricing model and his push for the Junk Fee Prevention Act to eliminate hidden fees. I urge you to cosponsor the One Fair Price Act and work to advance it through committee. Consumers deserve transparent, fair pricing that doesn't depend on how much personal data corporations have collected about their financial situations. This bill would restore basic fairness to the marketplace and protect Americans from algorithmic price discrimination. Thank you.
