Moving its administration to HHS would undermine its core purpose of ensuring students with disabilities receive an appropriate public education. This threatens to deprioritize special education programming, teacher training, research, and technical assistance vital for ensuring schools meet the needs of millions of students. As an education law, IDEA belongs under the Department of Education to uphold its educational focus and federal oversight role. Maintaining DOE's jurisdiction over IDEA is crucial for safeguarding the rights and services entitled to students with disabilities across the nation.
