This proposed legislation raises grave concerns about undermining the authority of federal courts and disrupting the crucial system of checks and balances enshrined in our Constitution. By severely limiting the ability of district courts to issue injunctive relief except in very narrow circumstances, it threatens to concentrate power in the executive branch at the expense of judicial oversight. This imbalance could enable unchecked executive overreach and erode vital constitutional constraints. While the bill allows for a special three-judge panel to grant injunctions in multi-state challenges to executive actions, this exception is insufficient to preserve the courts' essential role as a check on executive power. The random selection process for judges also injects an unacceptable degree of arbitrariness into such a pivotal function. Preserving the independence of the judiciary and its power to serve as a counterweight to the other branches is fundamental to our democratic system of government. This bill represents an alarming encroachment on that principle. I urge you to uphold the Constitution's framework and reject any measures that would undermine the courts' ability to act as a bulwark against abuse of power. Our system of checks and balances is too precious to compromise.
