WHY IS DHS LAUNCHING A VOTER FRAUD SURGE RIGHT BEFORE THE MIDTERMS? I am writing to you as a concerned constituent about a story that broke on August 31, 2026, and I believe it deserves your immediate attention. CNN reported that it had reviewed internal federal guidance showing the Department of Homeland Security is preparing to launch what it internally calls a “coordinated criminal voter fraud surge initiative” starting this Tuesday, September 1. The agency carrying this out is Homeland Security Investigations, a division of ICE. HSI’s normal caseload is human trafficking, narcotics smuggling, and child exploitation. It is not an election enforcement agency, which is itself part of why this guidance raised alarm among the people who reviewed it. Under this plan, HSI field offices in nine states, Washington, Wisconsin, Missouri, Georgia, California, Pennsylvania, Nevada, New York, and Connecticut, are expected to take investigative action on voter fraud from early September through mid-October. That window covers the heart of active midterm voting in several of those states. This timing matters because the Justice Department has long-standing internal policy discouraging major investigative actions this close to an election, specifically because the appearance or reality of federal agents scrutinizing voters can chill lawful participation. DHS is a separate department and is not bound by that DOJ policy, and the guidance CNN reviewed does not address the timing question at all. It is also worth noting that HSI has reportedly been building election-related cases for well over a year. If there were real concerns to investigate, there was time to do it well before ballots started going out. The credibility of the underlying claims is also in question. DHS has publicly stated that it found nearly 16,000 noncitizens on Nevada’s voter rolls. But internal records reviewed by CNN show the department privately confirmed only 185 of those cases, roughly one percent of the public number. That is a significant gap between what DHS says publicly and what it can actually substantiate, and it is the same department now directing a multi-state investigative surge based on similar claims. This is unfolding alongside a separate but related effort. The President has spent months publicly pressuring Congress to pass the SAVE America Act, which would require documentary proof of citizenship to register to vote and photo ID at the polls. The House passed a version of it in February 2026, and it has since stalled in the Senate for lack of votes to overcome a filibuster. I am not asking you to take a position on that bill here. I am pointing out that a federal investigative surge and a sustained legislative campaign, both centered on the same claim of widespread noncitizen voting, are happening in the same election cycle, and both deserve scrutiny rather than the benefit of the doubt. Importantly, concern about this is not limited to one party. Election officials in Georgia and North Carolina, both Republican-led states, have said DHS’s figures appear inflated and need independent review. Utah’s Republican Lieutenant Governor, who serves as that state’s top election official, has publicly said she does not trust the accuracy of the voter lists DHS has compiled. When officials from the President’s own party are raising these questions, it should tell you something. On a personal level, I do not want to see federal agents whose training and mission center on trafficking and smuggling instead spending the final weeks before an election combing through the voting histories of people in my community. Eligible voters deserve to trust that a data-matching error will not cost them their ballot, particularly when DHS’s own numbers show how unreliable that matching has been. Given all of this, I am asking you to: Demand a congressional oversight hearing requiring DHS to explain why these nine specific states were selected and why it bypassed the Justice Department’s usual pre-election timing safeguards. Request that the DHS Inspector General audit the data behind the 16,000-to-185 discrepancy in Nevada before any further investigative action proceeds in any state. Press DHS publicly on why it waited until weeks before voting to act, given that it has had over a year to raise these concerns through normal channels. DHS has not shown evidence of fraud at any meaningful scale. What it has shown is a sudden surge of agents, a companion legislative push aimed at the same voters, and no real explanation for its timing. Until DHS can answer “why now,” this initiative deserves real scrutiny from Congress, not a rubber stamp. Thank you for taking this seriously.
