The federal prosecution of Representative LaMonica McIver establishes an alarming precedent that threatens the constitutional balance between Article I and Article II. Regardless of party affiliation, every member of Congress has an institutional duty to defend the legislative branch's authority to conduct executive oversight without fear of retaliatory prosecution. On May 9, 2025, members of Congress exercised their statutory right to inspect an ICE detention facility in Newark, New Jersey. The resulting confrontation and subsequent three-count felony indictment of a sitting lawmaker marked an extraordinary escalation. A bipartisan group of former members of Congress—including 17 Republicans—filed an amicus brief warning that allowing this prosecution to stand erodes Congress's oversight powers and chills future facility inspections. Despite that bipartisan warning, a divided Third Circuit panel ruled on August 26, 2026, that Representative McIver is not immune from prosecution on two of the three counts. With her legal team evaluating an en banc rehearing or Supreme Court appeal, the window for congressional action is now. If the executive branch is permitted to criminalize contentious oversight encounters, it creates an unchecked tool to intimidate lawmakers and disrupt investigations. This is a separation-of-powers crisis. An executive branch with the power to selectively prosecute congressional watchdogs today can—and will—turn that same weapon against any party tomorrow. I urge you to take immediate institutional action: 1. Defend Legislative Independence: Direct the Bipartisan Legal Advisory Group (BLAG) and House General Counsel to file an amicus brief supporting rehearing en banc or Supreme Court review, affirming that on-site congressional oversight is constitutionally protected under Article I and the Speech or Debate Clause. 2. Exercise Committee Oversight: Convene immediate hearings in the House Judiciary and Oversight Committees to examine whether the Department of Justice and DHS coordinated selective arrests and prosecutions targeting lawmakers. Subpoena internal communications and body-worn camera footage related to the Delaney Hall incident. 3. Enforce Statutory Access Via Appropriations: Attach mandatory oversight language to upcoming DHS and DOJ funding bills, explicitly defunding retaliatory enforcement against members of Congress and guaranteeing unhindered statutory access to all federal detention facilities. When the executive branch uses criminal indictments to silence oversight, Congress must defend its co-equal status. Protect the constitutional prerogatives of the legislative branch before this precedent becomes permanent.
