Reject undemocratic "No Rogue Rulings Act" undermining judicial oversight
To: Sen. Fetterman, Sen. McCormick
From: A constituent in Harrisburg, PA
April 13, 2025
The proposed "No Rogue Rulings Act of 2025" threatens to severely undermine the system of checks and balances that is crucial to our democracy. By restricting federal judges from issuing nationwide injunctions against executive orders, this bill would consolidate power in the hands of the president and erode the judiciary's ability to serve as a check on executive overreach. This legislation is a transparent attempt by Republicans to insulate the Trump administration's controversial policies from judicial review. Democratic senators rightly express concerns that the President is weaponizing executive orders to undermine fundamental rights and democratic values. Nationwide injunctions have proved a vital tool for district courts to temporarily halt policies that likely violate constitutional protections while cases work their way through the legal system. Moreover, the proposed three-judge panel raises separation of powers issues by stripping power from individual district court judges. The interest of justice and risk of irreparable harm are better evaluated by judges closely examining the facts of each case rather than a centralized panel making blanket determinations. I urge you to reject this undemocratic power grab that would enable the president to enact legally dubious policies without judicial oversight. Protecting the system of checks and balances must be a paramount priority to uphold the rule of law and prevent executive branch overreach that could threaten civil liberties. Vote no on the "No Rogue Rulings Act" and defend the judiciary's essential role in our constitutional republic.
