Due Process Under the Law
To: Rep. Carey, Sen. Husted, Sen. Moreno

I am writing to you because I am concerned about the lack of due process given to people in the United States. The Fourteenth and Fifth Amendments prohibit the government from depriving any person of life, liberty, or property without due process of law. Furthermore, the Supreme Court said this right to due process cannot be denied for any reason including race, color, or citizenship. Those accused cannot just be deported without an opportunity to know why and to have counsel. All people deserve the right to present evidence and see the evidence presented by ICE. Instead people are being disappeared. That’s a verb now! People are being disappeared in what is supposed to be the greatest democracy in the world! We are used to people disappearing in places like North Korea, China, and Russia. Is that what the President is striving for? Does he want to be like countries that have long been known as dictatorships with a history of human rights violations through the decades? Let’s look at one such illegal act perpetrated by our government. By now I am sure you have heard of Kilmar Abrego Garcia, a father married to a US citizen with a special needs child, who was arrested and sent to the worst prison on earth, CECOT. He was accused of being part of the notorious MS-13 gang for simply having a tattoo! The Supreme Court agreed that Mr. Garcia must be returned to the US. Now the dictator head of El Salvador and our own President will not follow the Supreme Court’s order to return Mr. Garcia. How is this possible? What would happen if I defied a court order? President Trump is not a king! We have a system of checks and balances and the power of the executive branch must be checked and balanced by the legislative and judicial branches. You have this job and it is an important one or you will not even be needed as we slide into autocracy. And to top it off, today the President and Marco Rubio said that the dictator of El Salvador should build more of these inhumane “facilities” to house US citizens that oppose the will of the current administration! So by writing this letter to my duly elected representatives, I could become a target of this administration’s need to silence dissent by deporting Americans for exercising their constitutional right to free speech and the right to petition their government. I am not overreacting. You need to take measure to stop President. He is not making us safer. He is making us less free. Thank you.
