Keep Special Education Oversight in the Department of Education

Stop the transfer of IDEA oversight and preserve the Department of Education’s authority, expertise, and accountability for enforcing the Individuals with Disabilities Education Act. The administration claims nothing has changed because local school districts still write IEPs. That is a distraction. The issue is not who writes an IEP—it is who enforces IDEA, monitors states, investigates violations, issues guidance, and holds school districts accountable. IDEA is an education and civil rights law, not a health care program. Students with disabilities need strong federal educational oversight—not a bureaucratic reshuffling that weakens accountability. Protect IDEA’s enforcement, expertise, and the civil rights of children with disabilities.
