Protect judicial authority to enforce court orders
To: Sen. Husted

I strongly oppose the provision in Section 70303 that would prohibit federal courts from enforcing contempt citations against the government if no bond is posted by plaintiffs. This measure undermines the judiciary's authority to hold the executive branch accountable for defying court orders. It protects the administration from consequences when violating rights or ignoring rulings, eroding the system of checks and balances. Courts seldom require plaintiffs suing the government to post bonds, as it would make vindicating rights prohibitively difficult, especially for indigent individuals. Judges need discretion to find officials in contempt when lawfully issued orders are willfully disobeyed. Obstructing this vital judicial power subverts the rule of law. Rather than shielding executive overreach, Congress should reinforce mechanisms to compel compliance with court decisions. An independent judiciary able to enforce its rulings is essential for upholding constitutional principles and safeguarding individual liberties. I urge you to strike this unacceptable provision that impairs judicial authority and undermines democratic accountability.
