Urgent Oversight Needed on ICE Detention Deaths and Use of Force

I am writing to express deep concern about conditions in U.S. Immigration and Customs Enforcement (ICE) detention and to request immediate, constructive oversight. This year, at least sixteen individuals have reportedly died while in ICE custody. The public deserves transparent, timely information about each case. These events, viewed together with recent audits identifying persistent compliance gaps, suggest more than isolated lapses. Brief Supporting Evidence: Media tallies and congressional letters indicate 14–16 deaths to date this year; official ICE reporting can lag, but the cumulative count points to an alarming trend that merits independent review. Government Accountability Office (GAO) and DHS Office of Inspector General (OIG) inspections over the past two years have documented recurring noncompliance with detention standards, especially around medical care, documentation, and incident reporting, underscoring systemic weaknesses rather than singular failures. The New York video and DHS’s public characterization of the conduct as “unacceptable” demonstrate that accountability mechanisms must be swift, credible, and visible to maintain public trust. These issues do not merely reflect internal management challenges; they shape how Americans and the world perceive our commitment to lawful, humane, and competent enforcement. Local jail systems that experience clusters of deaths or serious misconduct typically face investigations and enhanced oversight; the federal civil detention system should meet at least that standard. Accordingly, I respectfully urge Congress to take the following actions: Require Independent Reviews of Every In-Custody Death Mandate prompt, external investigations with public summaries of findings, timelines, and corrective actions. Ensure next-of-kin notifications and access to records are timely and complete. Enforce and Modernize Detention Standards Codify baseline medical, mental-health, and safety protocols; link facility contracts and renewals to demonstrated compliance. Direct DHS to implement GAO/OIG recommendations with measurable goals, credible inspections (including unannounced visits), and public progress tracking. Strengthen Transparency and Data Reporting. Require standardized, near-real-time publication of deaths, serious incidents, and use-of-force data, along with investigative outcomes. Harmonize definitions (e.g., “in custody”) to prevent under- or over-counting and to improve comparability across facilities. Improve Accountability for Misconduct Establish clear, public disciplinary pathways for substantiated violations and ensure whistleblower protections for staff and contractors. Provide independent avenues for detainee complaints with guaranteed receipt, tracking, and resolution. These steps are pragmatic, balanced, and consistent with the expectations Americans hold for any custodial system: safety, legality, transparency, and accountability.
