Reject OPM's Proposal to Collect Identifiable Medical Records

To: Sen. Padilla, Rep. Chu, Sen. Schiff

From: A constituent in Pasadena, CA

April 8

I'm asking you to publicly oppose and block the Office of Personnel Management's proposal to collect identifiable medical records from 8 million federal workers, retirees, and their families. This sweeping data grab violates HIPAA protections and creates dangerous potential for political retaliation. OPM's December notice demands monthly reports with medical claims, pharmacy records, and encounter data from 65 insurance companies, but fails to require redaction of identifying information like names and birth dates. CVS Health and the Association of Federal Health Organizations have both raised serious HIPAA compliance concerns, noting that federal law allows OPM to examine records, not collect personal health data for "vague and broad general purposes." Insurers could face legal liability for handing over this information. The timing matters. This administration has already fired thousands of federal workers, with dozens claiming political retaliation. Access to records showing who sought abortion care or transgender treatment creates obvious risks for targeting employees. OPM has provided zero information about how it would protect this data once collected. OPM lost 22 million Americans' personal records in a 2015 data breach. The agency cannot be trusted with an even more sensitive database of detailed medical information. Reject this proposal and demand OPM withdraw it entirely.
