Block Trump's Unconstitutional Mail-In Voting Order

To: Rep. Chu, Sen. Padilla, Sen. Schiff

August 27

You need to act now to protect mail-in voting before the midterms. The Supreme Court's Republican supermajority just greenlit Trump's executive order restricting mail-in ballots — an order that 23 states sued to stop, and that a federal district judge already blocked as unconstitutional. The court didn't rule on the merits. They hid behind "ripeness," claiming no harm has occurred yet. That's a fiction. State election officials are being threatened with federal prosecution right now for following their own states' procedures. This executive order is a direct assault on state authority over elections. Voter registration is a state function — the federal government has no constitutional power to hand Homeland Security the keys to voter rolls, weaponize the DOJ against local officials, or instruct the Postal Service to block ballot delivery. Justice Ketanji Brown Jackson called it exactly what it is: a bad-faith effort to foment chaos ahead of November. Early voting starts in some states in six weeks. Congress cannot sit on its hands while the court helps rig an election. I want to see you introduce or co-sponsor emergency legislation protecting states' authority over mail-in voting, and publicly demand the court take up the merits before a single ballot is suppressed. Our democracy does not survive a Supreme Court that knowingly assists in election manipulation.
