Under Article I, Section 4 of the Constitution, the authority to govern federal elections belongs strictly to state legislatures and Congress. The Framers excluded the Executive Branch so no sitting president could rewrite voting rules to retain power. Yet today, the Executive Branch is attempting to usurp this authority through unverified claims and administrative decrees: - Manufactured Pretexts Fall Apart: The administration claimed federal reviews found over 250,000 noncitizens registered across four states, including nearly 16,000 in Nevada. DHS could identify only 185 records for review, and Nevada verified every single one was a U.S. citizen. The confirmed noncitizen total was zero. Inventing fake fraud metrics to justify federal takeover of voter rolls violates the public trust. - Refuted by Conservative Databases: The Heritage Foundation’s database documents only about 1,500 proven voter fraud cases nationwide over several decades—a fraction of one percent out of billions of ballots. There is zero basis for emergency federal intervention. - Executive Decrees Blocked in Court: When legislation stalled, the administration directed the Postal Service to restrict mail-in ballots. Federal judges and the Supreme Court blocked the rule, reaffirming the executive branch has no statutory authority to dictate state election procedures. - Targeting State Voter Data: DOJ sued states demanding sensitive voter records, including Social Security numbers. Federal courts repeatedly rejected these demands, ruling the executive branch has no legal right to state voter files. Allowing the White House to rewrite election rules by decree degrades Congress into a bystander. I demand you take immediate action: 1. Reject Executive Rewrites: Oppose enforcing stalled election bills (like the SAVE Act, H.R. 22 / S. 128) by executive decree. 2. Protect Voter Privacy: Bar federal agencies from demanding state voter rolls with sensitive personal identifiers without a warrant. 3. Use the Purse: Attach binding riders prohibiting DHS, DOJ, and the Postal Service from policing mail ballots or interfering with state elections. Protect state sovereignty, defend your Article I authority, and uphold the Constitution.
