Please SIGN SB 423 (Gonzalez), the Detention Facility Transparency Act
To: Gov. Newsom
From: A verified voter in Carlsbad, CA
September 19
Please SIGN SB 423 (Gonzalez), the Detention Facility Transparency Act. SB 423 requires disclosure of 911 and other calls reporting incidents at privately run, for-profit detention facilities, including the immigration detention centers operating in California, along with written complaints and related law enforcement records, while protecting identifying information and allowing certain records to be withheld when disclosure would substantially interfere with an active investigation.
About 6,400 people are held in privately run immigration detention in California on an average day, nearly three-quarters of whom have no criminal record. Six detainees died at the Adelanto and Imperial facilities between September 2025 and March 2026, the most since the state began annual oversight of detention centers. Attorney General Bonta's fifth report found inadequate medical care, overcrowding, and unsafe and unsanitary conditions, and he called them cruel, inhumane, and unacceptable.
The people inside cannot leave or seek care elsewhere. When records of their emergencies are kept from public view , the public may have no independent account of what happened. At Otay Mesa, at least seven reported sexual assaults went uninvestigated by the Sheriff’s Department under an agreement that gave the detention center’s warden authority to decide whether to investigate, and reporters who requested records about the cases were denied under the investigative records exemption.
The right to humane treatment in custody does not depend on immigration status. Please SIGN SB 423.
