Ethics Loopholes #6: Our Conflict-of-Interest Law Doesn't Cover the President?
To: Sen. Husted, Rep. Beatty, Sen. Moreno
From: A verified voter in Columbus, OH
October 21
I am writing as your constituent to address a critical structural gap in federal ethics law: the primary conflict-of-interest statute, 18 U.S.C. § 208, explicitly excludes the President and Vice President. While the Foreign Emoluments Clause and federal bribery statutes exist, recent events highlight how easily executive accountability is bypassed: - The $400 Million Qatari Jet: A Boeing 747-8 gifted by Qatar's royal family entered executive service alongside newly signed bilateral defense and security pacts, with taxpayers funding military retrofits. Administration legal opinions claimed the jet was gifted to the Air Force, shielding it from emoluments restrictions while preserving its eventual transfer to a private presidential library foundation. - Selling Executive Access: Trump Media launched Truth API, selling real-time data feeds of official executive posts to Wall Street trading firms for up to $100,000 per month milliseconds prior to public dissemination. - Clemency Monetization: Convicted founder Trevor Milton received a pardon wiping out $675 million in court-ordered victim restitution two weeks after prosecutors requested it, following $1.8 million in contributions to allied political committees. Reporting documented over $10 million in contributions from clemency recipients, advocates, and affiliated entities surrounding recent clemency decisions. On October 17, 2026, Vice President JD Vance stated during a televised town hall that if anyone is selling access to the White House, it is "disgusting and despicable" and they "should suffer consequences." Congress must write explicit statutory standards into federal law to make that principle enforceable. Congress holds clear Article I authority over federal ethics, defense spending, and foreign gift dispositions. I urge you to take immediate legislative action to: 1. Mandate Air Force accounting: Require the Department of the Air Force to state in writing by November 6 the total taxpayer cost for retrofitting the Qatari aircraft and clarify whether ownership will transfer to a private presidential foundation. 2. Enact the Murphy Amendment: Attach binding statutory language to the upcoming defense spending bill barring federal funds from being used to transfer foreign-donated military assets to private presidential foundations. 3. Reform foreign gift laws: Amend the Foreign Gifts and Decorations Act (5 U.S.C. § 7342) to explicitly prohibit transferring foreign-donated government property to private entities controlled by former executive officials. 4. Close conflict loopholes: Introduce and pass legislation extending 18 U.S.C. § 208 conflict-of-interest standards directly to the President and Vice President. Reclaim your Article I authority and write real consequences into federal law.
