It is a gross hypocrisy to force working Americans to comply with the tax code while the executive branch unilaterally exempts itself from IRS scrutiny. The narrative that this crisis is resolved simply because a federal judge recently struck down the DOJ's May 19 tax immunity directive is a comfortable lie.
Without concrete statutory action, the door remains wide open for future administrations to deploy this same procedural machinery to create a separate, elite tier of justice. The Department of Justice's weaponization of its settlement authority must be structurally dismantled by the legislature.
Do not wait on the courts to resolve executive overreach. I demand concrete institutional accountability anchored to the legislative record. Tomorrow, the Senate Finance Committee marks up the Taxpayer Assistance and Service (TAS) Act. You must use this active procedural mechanism to introduce and support binding amendments—and attach riders to all upcoming appropriations bills—that explicitly prohibit any federal funds from being used to recognize, implement, or enforce this illegitimate tax immunity deal.
I expect you to go on the official roll-call record against this abuse of power. Failure to actively block this procedural machinery makes Congress complicit in the abuse.
