Dear Members of the Colorado General Assembly,
I am writing to urge you to introduce and swiftly pass legislation that would make it a criminal offense for any federal agent—or any person claiming to act under federal authority—to operate in Colorado while masked and unidentified.
Over the past several years, we have seen alarming reports of masked individuals in unmarked vehicles detaining civilians without identifying themselves or producing warrants. These tactics, often claimed to be federal actions, violate the foundational principles of due process, transparency, and public trust in law enforcement. They echo authoritarian methods of repression, not the democratic standards we uphold in Colorado.
We must act preemptively. Colorado has the right and responsibility to protect its residents from unlawful detainment and intimidation. Our state can and should require that any law enforcement officer operating here—regardless of agency—clearly identify themselves and their legal authority. Anyone refusing to do so while armed and masked should be subject to arrest and prosecution under state law.
This is not just a matter of legal jurisdiction—it is a matter of public safety, civil rights, and preventing potential abuse of power. State and local law enforcement are accountable to the communities they serve. Unidentified, masked agents acting without oversight are not.
I urge you to introduce and pass legislation that includes:
A ban on any law enforcement action in Colorado conducted by individuals who refuse to identify themselves or their agency;
Legal penalties, including arrest, for impersonating law enforcement or conducting unauthorized detainments while masked or unidentifiable;
Provisions to ensure cooperation with local law enforcement in holding violators accountable, regardless of federal affiliation.
Coloradans should never have to wonder whether a masked person dragging someone into a van is enforcing the law or breaking it. We deserve clarity, safety, and accountability.
