Today I’m writing to you in favor of H.R. 3562, in order urge you to pass this important legislation and create a federal civil right of action against non-consensual, sexually-explicit "deepfakes”. [DEFIANCE Act 2025] The situation is a deeply disturbing issue that demands immediate action. These Al-generated forgeries, which realistically depict individuals in pornographic situations without their consent, inflict severe harm on victims. Studies show a staggering 96% of deepfake videos online involve non-consensual pornography, often targeting women and girls. The psychological trauma, reputational damage, and privacy violations suffered by victims are unacceptable. This bipartisan DEFIANCE Act provides a much-needed solution by creating a federal civil right of action for victims to pursue justice against perpetrators of these malicious deepfakes. The bill creates a legal framework that allows victims to take legal action and hold abusers accountable, this legislation empowers survivors and serves as a powerful deterrent against this invasive exploitation. The rampant abuse enabled by deepfake technology demands a firm legislative response NOW to protect individual dignity, consent, intellectual property, and online safety, where these deepfakes are often used. I urge you to lend your full support to swiftly passing this crucial legislation.
