I am writing to express serious concern regarding the ongoing legal battle involving the firing of a Merit Systems Protection Board (MSPB) member and the subsequent appeal to the United States Supreme Court. This issue is not just about one individual, it goes to the heart of whether longstanding protections for federal employees and the independence of key oversight bodies will continue to exist. The MSPB plays a critical role in protecting federal workers from political retaliation, ensuring that hiring, firing, and disciplinary actions are based on merit rather than politics. It also serves as a vital avenue for whistleblowers and employees seeking due process. Weakening or politicizing this board undermines the integrity of the entire federal workforce. Federal law has historically been clear. MSPB members can only be removed for cause, such as inefficiency, neglect of duty, or malfeasance. This protection exists to preserve the Board’s independence. This principle is rooted in long standing Supreme Court precedent affirming that Congress may limit a president’s ability to remove officials from quasi judicial bodies in order to safeguard impartial governance. However, recent court rulings have called these protections into question, suggesting that the President may have broader authority to remove members of independent agencies. If upheld, this shift could fundamentally alter the balance of power and dismantle the independence of agencies designed to serve as checks within the executive branch. The consequences are significant. The MSPB is already facing increased caseloads and reduced staffing while handling a surge in appeals tied to federal workforce actions. Undermining its independence at this moment risks leaving federal employees without meaningful recourse and eroding confidence in fair and lawful personnel practices. This case is about more than administrative structure, it is about whether rules still apply and whether safeguards against political interference will be preserved. I urge you to take a clear position in support of maintaining statutory protections that prevent the arbitrary removal of MSPB members, defending the independence of oversight and quasi judicial federal agencies, and ensuring federal employees retain access to fair, impartial review of employment disputes. Congress has a responsibility to uphold the rule of law and preserve the systems that protect both federal workers and the public they serve. I respectfully ask that you speak out on this issue and take legislative or oversight action to ensure that these critical protections are not dismantled.
