Multi-billion dollar insurance conglomerates pocket historic Texas premium increases while engineering loopholes to deny claims. Their most deceptive tactic targets Loss Assessment Coverage for Texas condo owners and housing co-ops, leaving working-class families facing sudden, catastrophic debt.When climate disasters—like severe Texas freezes, hurricanes, hail storms, or convective winds—damage common property, housing associations must levy a "special assessment" for repairs. Insurers intentionally use two contradictory rules to create a trap door where premium-paying families are stripped of their safety net:The "Date of Loss" Rule: Insurers deny claims if the physical storm happened before a Texan bought their home, ignoring that the resident was billed today.The "Date of Assessment" Rule: Insurers deny claims if the assessment is billed after a policy ends, ignoring that the policyholder paid premiums during the actual storm.This predatory inconsistency allows corporations to pass the buck, collect double premiums, and leave neighbors with out-of-pocket bills that trigger foreclosures, debt spirals, and displacement. This systematically strips wealth from fixed-income seniors, immigrant families, and working-class neighborhoods across the state of Texas.Our Demands to the Texas Department of Insurance (TDI):We demand immediate, binding regulatory action to enforce:Mandatory Dual-Trigger Protection: If a Texas policyholder held active coverage either on the Date of Property Damage OR the Date of the Assessment, the claim must be paid.An End to Corporate Finger-Pointing: If a Texas resident maintained continuous coverage, the current insurer must pay immediately and settle historical disputes with the prior carrier behind closed doors.Plain-Language Disclosures: Force Texas insurers to prominently state their exact trigger rules on the declaration page, eliminating hidden text used to trick buyers.We refuse to let insurance corporations extract wealth from Texas neighborhoods while abandoning us during climate crises. Stand with us to demand housing stability and economic justice.
