As your constituent, I am writing to ask you to step up courageously and act to impeach Donald J Trump for breaking the law, ignoring the Constitution, and intentionally defying Supreme Court (and lower court) orders in the example outlined below. Congress must recognize the moment when an impeachable offense by the Executive (President) has occurred and courageously take action. The Supreme Court in 2024 granted broad immunity to the Executive and recognizes ONLY impeachment by the House and a trial resulting in conviction in the Senate to hold an Executive accountable for breaking the law and violating the Constitution. The example case is the deportation of Kilmar Ábrego García. • Garcia was taken by agents of the US Government and deported to an El Salvadoran prison without the due process guaranteed by the Fifth and Fourteenth Amendments to the US Constitution. This is abuse of power, an impeachable offense. • The El Salvadoran government is being paid with US tax dollars to house whomever the Executive Branch says is a criminal and says is deportable under the law as interpreted by the Executive Branch - ignoring the rights guaranteed by the US Constitution, the laws written by Congress and interpreted by the Judiciary. This Executive is behaving as a dictator rather than recognizing the three, co-equal branches of our government as outlined in the US Constitution. This is abuse of power, an impeachable offense. • The Attorney General (AG) publicly states a verbal charge that Garcia is a criminal, with no evidence or due process. The AG is complicit in the unlawful and unconstitutional action. We cannot depend on the AG to enforce US laws with integrity. • The Supreme Court ruled that the US Government is to facilitate Garcia’s return. The Judiciary is doing their part to apply the checks and balances. • The Executive refuses and actively ignores Supreme Court (and lower court) orders, even posts on social media that the man (Garcia) won't be coming back. This is demonstrating blatant disregard for the Judiciary's role. The Executive’s actions and words are evidence indicating the Executive has no intention to act as directed by the Supreme Court to facilitate Garcia's return. This is abuse of power, an impeachable offense. • This Executive has expressed his belief that only the Executive Branch (AG and President in this case) interprets US law and constitution. This Executive acts with blatant impunity demonstrating his belief that as President is not required to abide by laws and the Constitution. This is abuse of power, an impeachable offense. This is just ONE example of this Executive ordering and defending unlawful / unconstitutional actions and defying the checks and balances setup by the US Constitution. Why is Congress NOT acting to impeach? The lack of Congressional action to impeach is perplexing and a dereliction of duty. Please step up to begin the impeachment process, which only Congress is empowered to do.
