The 14th Amendment granted equal rights and citizenship to all persons born or naturalized in the United States, including formerly enslaved people. Section 3 prohibits anyone who has engaged in insurrection or rebellion against the United States from holding federal or state office. This provision aimed to prevent Confederate leaders from returning to power after the Civil War. Enforcing the 14th Amendment requires barring individuals found guilty of participating in the January 6th insurrection from holding public office, in order to uphold the Constitution and protect American democracy. We must address disparities and systemic racism while safeguarding the republic from those who sought to overturn a free and fair election through violence.
