Oppose Trump's $10 Billion IRS Lawsuit to Prevent Self-Dealing

To: Rep. Wied, Sen. Johnson, Sen. Baldwin

February 5

I am writing to urge you to take action against President Trump's $10 billion lawsuit against the IRS, which represents an unprecedented case of potential self-dealing with taxpayer funds. The President is suing his own government over the leak of his tax information, creating a situation where he would effectively negotiate a settlement with himself and control how taxpayer dollars are distributed. While Trump has a legitimate claim under IRS Code 6103 regarding the 2018-2020 leak by former contractor Charles Edward Littlejohn, legal remedy has already been provided. Littlejohn was sentenced to five years in prison in 2024, the Treasury Department canceled contracts with his employer Booz Allen Hamilton, and the IRS issued a rare public apology and pledged to strengthen data protection. The system worked as intended. The $10 billion amount sought raises serious concerns. The law provides a minimum of $1,000 per disclosure for leaked tax information. When asked about managing both sides of this lawsuit, Trump referenced a previous $230 million complaint against the Department of Justice and suggested he would "work out a settlement with myself" and donate "a substantial amount" to charity. However, the White House has provided no details on which organizations might receive settlement money, leaving taxpayers in the dark about how their funds could be used. Tax attorney David Gair notes that Trump may have difficulty proving real harm given the business deals the Trump family has secured since his reelection. This lawsuit appears designed to extract taxpayer funds rather than address genuine damages. Since Littlejohn also leaked tax records of Jeff Bezos and Elon Musk, this case could set a precedent for other billionaires to pursue similar claims against the government. I urge you to publicly oppose this lawsuit and work with colleagues to prevent any settlement that would allow the President to direct taxpayer funds to himself or organizations of his choosing. This is self-dealing that must be stopped.
