Rescind the Unconstitutional Drone Flight Restriction

To: Sen. Padilla, Sen. Schiff, Rep. Fong

The FAA's nationwide drone restriction, TFR FDC 6/4375, must be rescinded immediately. This 21-month ban prohibits flying drones within 3,000 feet of any Department of Homeland Security vehicle or facility across the entire United States. It's an unconstitutional attack on our First Amendment right to record law enforcement. Nearly every federal appeals court recognizes the constitutional right to record police performing official duties. This restriction criminalizes that right. Civilian recordings exposed the truth about George Floyd's murder, Renée Good's killing, and Alex Pretti's shooting after government accounts proved false. Without that documentation, those officers would have faced no accountability. The restriction also violates due process. ICE agents use unmarked rental cars and vehicles without license plates. Drone operators have no way to know if they're within 3,000 feet of these unmarked vehicles, yet face criminal penalties, civil fines, and drone destruction for violations. That's punishment without fair notice. The timing reveals the real purpose. The FAA issued this restriction in January 2026 during Minneapolis anti-ICE protests, right when civilian recordings were documenting immigration enforcement abuses. This isn't about safety. It's about shielding ICE from scrutiny. Demand the FAA withdraw TFR FDC 6/4375. Our right to document government actions cannot be eliminated by administrative fiat.
