Oppose ICE Warrantless Home Entries and Protect Fourth Amendment Rights

To: Sen. Cornyn, Rep. Weber, Sen. Cruz

From: A verified voter in Galveston, TX

January 22

I am writing to urge you to take immediate action to stop Immigration and Customs Enforcement from entering homes without judicial warrants. According to a recent ICE memo obtained by the Associated Press, agents are now being authorized to forcefully enter private residences without warrants from judges, a practice that directly contradicts Fourth Amendment protections. The Fourth Amendment explicitly states that "the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." This constitutional protection applies to all people within U.S. borders, not just citizens. Allowing federal agents to bypass judicial oversight and enter homes without warrants sets a dangerous precedent that threatens the civil liberties of everyone in your district. These expanded operations are currently taking place in multiple states, including Maine, and represent a fundamental shift in how immigration enforcement interacts with constitutional protections. When any federal agency can enter private homes without judicial authorization, it erodes the checks and balances that prevent government overreach. This policy affects not only immigrant families but every constituent who values their right to privacy and security in their own home. I ask you to publicly oppose this policy and introduce or support legislation that explicitly requires ICE agents to obtain judicial warrants before entering private residences. Additionally, please use your oversight authority to investigate who authorized this policy change and on what legal basis they claim this authority. Our immigration system can be enforced without dismantling constitutional protections that have safeguarded Americans for over two centuries.
