Congress has granted the president limited, emergency authority to deal with any “unusual and extraordinary threat” by “investigating, regulating, or prohibiting” international transactions. See the International Emergency Economic Powers Act. The limited powers granted to the president by Congress in the IEEPA do not include the authority to impose tariffs. In response to Trump's earlier attempts to impose unilateral, reciprocal, and punitive tariffs, the US Court of International Trade (CIT) ruled that Trump did NOT have the power to impose tariffs under the IEEPA because, among other reasons, trade deficits are a long-standing feature of US trade relations that do not constitute an emergency. The decision by the US Court of International Trade concluded that Trump's executive order imposing worldwide reciprocal tariffs was unconstitutional. Trump has ignored the fact that the US Court of International Trade has ruled that his tariffs are unconstitutional, by forging ahead and announcing a new round of reciprocal tariffs worldwide. This normalizes his lawlessness! Trump has totally ignored the Constitution. He has withheld funds appropriated by Congress, abolished agencies established by statute, suspended the writ of habeas corpus, the Due Process Clause, and denied birthright citizenship to millions of Americans. As an officer of the United States, his first duty is to “faithfully execute the laws” enacted by Congress and enshrined in the Constitution! Trump does NOT have the authority to impose worldwide tariffs. His unlawful sanctions are causing pain for US businesses and consumers. The US has collected about $22 billion in new tariffs in May, alone, which is a direct tax on US consumers in the form of price hikes! Trump promised to target violent criminals and gang members for deportation. Instead, he targeted the entire immigrant community in the US—approximately 48 million immigrants, naturalized citizens, even those with passports and legal resident status! YOU MUST protect immigrants in the US, while awaiting the opportunity to reform immigration laws! America is a great nation because of immigration. YOU must stop Trump's terror campaign against law-abiding, productive immigrants who are part of the fabric of America. Trump’s war on government is an indirect war on the people, who rely on the government to protect them and make their lives better. YOU must reclaim the commitment to government that seeks to protect the people and all those you represent! The more that Trump normalizes his lack of compassion for humanity and his avoidance of the rule of law, the greater the peril to constitutional order. YOU, as a member of Congress, and my representative, MUST take back control!
