I'm calling on you to support designating transgender people as a suspect class under equal protection law. This legal standard is the right approach and deserves your vocal backing. The reasoning is straightforward. When cisgender people can update identity documents to match their gender identity but transgender people cannot, that's sex discrimination. When someone is prevented from obtaining the same attributes of public life based on their sex, strict scrutiny is the appropriate standard. This isn't radical—it's the same framework we've applied to discrimination based on race and religion for decades. Suspect class designation doesn't prevent legislatures from addressing legitimate policy questions. It simply requires that any law discriminating against trans people must serve a compelling state interest and be narrowly tailored to achieve it. That's a reasonable bar that protects civil rights while preserving space for genuine governance. Montana's Supreme Court recently led on this issue in Kalarchik v. State of Montana. Other states should follow. I expect you to advocate for this standard in our state and oppose any attempts to undermine courts that adopt it.
