Expand the Supreme Court to Restore Its Legitimacy

Support Supreme Court expansion. The current Court has become so ideologically erratic that lawyers cannot advise clients, and lawmakers cannot predict whether legislation will survive. That is not a functioning judiciary — it is an unaccountable political body with lifetime tenure. The evidence is damning. The Court invented a "major questions doctrine" applied exclusively against one president. It used the shadow docket — no full opinion, no oral argument — to declare that public school teachers must out transgender students to their parents. In Wolford v. Lopez, Justice Alito struck down Hawaii's gun law despite nearly identical 18th-century precedents, inventing a "poaching" distinction that has no basis in the Court's own Bruen framework. A federal appeals court, applying Bruen, struck down the domestic violence restraining order gun ban because spousal abuse wasn't illegal until 1871. These aren't controversial decisions — they're incoherent ones. A Court that abandons its own principles without explanation loses the legitimacy that makes presidents and legislatures comply with its rulings. Expansion is the constitutional remedy Congress has always had. Use it.
