Cosponsor and Support H.R. 9133 — Accountability for Government Censorship Act

To: Rep. Mannion

From: A verified voter in Syracuse, NY

October 26

I'm writing to ask you to cosponsor H.R. 9133, the Accountability for Government Censorship Act. Rep. Scott Perry introduced it on June 3, and it's currently sitting in the House Oversight and Government Reform Committee with just one cosponsor, so it needs people like you to sign on. What the bill actually does is modest. Each federal agency, including offices inside the Executive Office of the President, would report to OMB on any contacts with online platforms over the past five years aimed at getting lawful speech removed, suppressed, labeled, or made harder to reach. Those reports would identify the officials involved, the platform employees they spoke with, the legal authority they cited, the stated justification, and the outcome. Inspectors general would review compliance, and OMB would compile everything for Congress. Identities and claimed authority would have to stay unclassified. Here's why that matters to me. When the Supreme Court decided Murthy v. Missouri in 2024, it dismissed the jawboning claims on standing and never reached whether the pressure was constitutional. As Public Knowledge observed afterward, that leaves the whole architecture of government-platform communication essentially untouched, and leaves speakers in a trap where the harm is over before they can prove it happened. Disclosure is one of the few fixes that doesn't require catching an agency in the act. The Knight First Amendment Institute has made a similar case: you can't sort legitimate persuasion from unlawful coercion without knowing where the contacts are occurring in the first place. I won't pretend the bill is everything I want. Groups tracking it, including Reclaim The Net, note that it looks backward only, doesn't notify the people whose posts were targeted, and creates no remedy for them. Fair criticism. But a public record is the prerequisite for any of that, and right now we mostly have rumor and litigation scraps. Please cosponsor H.R. 9133 and press for a committee markup. I'd appreciate hearing where you land on it.
