Repeal the Congressional Review Act to Restore Regulatory Stability I am writing to urge you to support legislation repealing the Congressional Review Act. This law has proven to be a reckless tool that undermines effective governance and creates dangerous uncertainty for both environmental protection and economic stability. The CRA allows Congress to rapidly overturn agency regulations without the traditional rulemaking process. While it was used only once before 2017, its application exploded during the Trump administration, with sixteen regulations repealed in 2017-2018. President Biden and Congressional Democrats then used it three times in 2021. This pattern demonstrates how the CRA has become a partisan weapon rather than a thoughtful check on regulatory overreach. The law suffers from poor drafting that creates unintended consequences taking years to fully manifest. Its vague provisions have received minimal judicial interpretation, leaving critical questions about its scope unanswered. This ambiguity makes it nearly impossible for any administration to develop long-term policies addressing complex challenges like climate change that require sustained, predictable regulatory frameworks. The CRA creates profound uncertainty for all stakeholders. Businesses cannot plan investments when regulations may be suddenly eliminated. Environmental advocates cannot build on regulatory progress when rules remain vulnerable to rapid repeal. This instability serves no one's interests and actively harms our ability to address urgent environmental and economic challenges. Most troubling, the CRA has the potential to artificially constrain future legislation by creating barriers to effective policymaking. As we confront the climate crisis and other pressing environmental issues, we need regulatory tools that enable thoughtful, durable solutions, not mechanisms that inject chaos into the administrative process. I urge you to cosponsor and support legislation repealing the Congressional Review Act. Restoring regulatory stability and predictability will benefit constituents across the political spectrum and enable the long-term planning necessary to address the challenges facing our communities.
