I urge you not to support the No Rogue Rulings Act of 2025 (NORRA). This bill would severely restrict the ability of federal district courts to issue injunctive relief, a crucial power that checks executive overreach and safeguards constitutional rights. The proposed limitations undermine the constitutional separation of powers and risk causing irreparable harm to those impacted by unlawful government actions. Under NORRA, district courts could only issue injunctions applying to the specific parties before them, essentially prohibiting nationwide or universal injunctions that prevent the enforcement of unconstitutional policies across the country. This constitutes an unacceptable infringement on the judiciary's authority and disrupts its role as a co-equal branch providing checks and balances. Furthermore, the bill's allowance for three-judge panels to issue broader injunctions is an insufficient safeguard. The random selection process lacks transparency, and having to convene special panels for every such case would be highly inefficient and delay justice. Stripping district courts of their long-standing equitable powers represents an assault on their independence and ability to uphold the rule of law impartially. I implore you to reject this misguided legislation that undermines our democratic system of government. The federal judiciary must retain its full authority to issue remedies protecting the rights of all Americans when confronted with unlawful executive action.
