Impeachment Inquiry Warranted for Attorney General’s Failure to Execute the Law

To: Sen. Fetterman, Rep. Houlahan, Sen. McCormick

From: A constituent in Reading, PA

January 17

Congress passed, and the President signed, legislation requiring the release of records related to Jeffrey Epstein by a clear statutory deadline. That deadline has passed. The law has not been executed. As Attorney General, Pam Bondi is the nation’s chief law enforcement officer and is responsible for ensuring that federal law is faithfully carried out. Failure to comply with a mandatory disclosure requirement enacted by Congress raises serious concerns about dereliction of duty, obstruction, and abuse of authority. This is not a matter of discretion or prioritization. Congress did not suggest or encourage disclosure—it required it. The Attorney General does not have the authority to ignore, delay indefinitely, or selectively comply with a law simply because compliance may be politically inconvenient or embarrassing to powerful interests. To date, there has been no adequate public explanation for the missed deadline, no transparency regarding who authorized noncompliance, and no clear legal justification for withholding records Congress ordered released. That silence itself undermines public trust in the Department of Justice and the rule of law. Impeachment exists precisely for situations like this: when an executive officer refuses to execute the law or places themselves above congressional authority. Criminal conduct need not be proven to justify impeachment; willful failure to perform constitutional duties is sufficient. Congress must open an impeachment inquiry to determine why the Attorney General failed to comply with the law, who benefited from that failure, and whether this conduct constitutes contempt of Congress or a violation of the constitutional obligation to faithfully execute the laws of the United States. If the Attorney General can ignore a statutory mandate without consequence, then congressional oversight is meaningless.
