Due process and habeas corpus are not optional

To: Sen. Cruz, Rep. Van Duyne, Sen. Cornyn

From: A constituent in Dallas, TX

May 17

I am writing concerning this Republican administration’s utter disregard for the right to due process and its desire to suspend the right to habeas corpus. Due process and habeas corpus are the only way to ascertain a detained person’s guilt-or-innocence and their immigration status. Suspending either means anyone can be detained without cause for any reason, with no legal recourse. These Immigration and Customs Enforcement “arrests,” without giving the seized person the chance to defend themselves, are abductions. They are illegal. Innocent until proven guilty is the basis for our country’s rule of law. We only have a democracy if due process and rule of law are applied equally to everyone. Otherwise, we become an autocracy. This Republican administration is showing it autocratic tendency by ignoring a Supreme Court ruling regarding the return of Kilmar Abrego Garcia so he may receive due process to determine what crimes he is, or is not, guilty of. It has now ignored three such rulings concerning all ICE detainees. Congress must act to ensure America does not become an authoritarian state. Congress should not be subservient to the executive branch of government. You and your fellow members of Congress must hold this administration accountable. Please do your duty to the Constitution, the country, and your constituents. Demand due process for all detainees. Protect the right to habeas corpus.
