Hands Off Olmstead! Yesterday, Trump’s DOJ quietly released a legal opinion claiming that the Americans with Disabilities Act does NOT require states to provide home and community-based care. In plain English: they’re arguing states can warehouse disabled people in institutions instead of supporting them to live at home. This is an attack on the foundation of disability rights in the United States. In 1999, the Supreme Court ruled in Olmstead v. L.C. that disabled people have the right to receive services in their own communities, not locked away in facilities. The right to live in our own homes is not negotiable.
